JessaKae Privacy Policy

In order for JessaKae, LLC to provide services and specifically the JessaKae services outlined in the Terms of Service including but not limited to the websites, www.JessaKae.com; www.shopjessakae.com; www.jessakaephoto.com; and any additional websites and or blogs owned by JessaKae, LLC, we may store, collect, and process various forms of information submitted by you electronically. Specifically, we collect personal information you have provided to us, non-personal information (e.g. device identifiers, IP addresses, etc.), and location-based information. This privacy policy (“Privacy Policy”) describes the means and methods JessaKae uses to collect, use, and disclose your information in connection with the use of our services. Except as otherwise indicated, customers and other persons using the Services are individually and collectively referred to as “you”, “your” or “user”, and JessaKae, LLC. and its subsidiaries and affiliates are referred to as, "JessaKae", "we", "us" and "our."  This Privacy Policy is subject to the JessaKae Terms of Service and any defined terms undefined in this Privacy Policy shall have the meanings as set forth within the Terms of Service.

Your continued access and use of the JessaKae Services, subject to the Terms of Service, signifies your consent to the terms of this Privacy Policy.

A. Personal Information. In order to access and utilize the JessaKae Services, you may be required to register or submit information.  We may collect the following information from you: (1) name; (2) email address; (3) date of birth; (4) password; and (5) mailing address. All registration information provided to us must comply with the JessaKae Terms of Service. 

As part of the user experience, you may also exchange information with us that would be considered personal information. Examples include but are not limited to the following: (1) information provided when you download or use applications from us; (2) information you enter into our system as part of using our Services including any newsletter or blog subscriptions; and (3) information you provide to us when contacting us for help, a refund, returns, or other communications.

1. Specific Use of Personal Information. The information we collect allows us to provide you with a relevant user experience as well as a mechanism to keep you informed on JessaKae’s latest product announcements, blog information, software updates, and promotional information. If you so desire, you can remove yourself from our mailing list by opting out by updating your profile preferences.

Other uses of personal information may be for validating a user account, fraud prevention, or other data safety precautions JessaKae may elect to implement. Additionally, we may use personal information for our internal purposes such as data analysis, auditing, and research to improve our services to you.

In terms of registered users who purchase merchandise from JessaKae, we collect information about your purchase history such as the information, feature, product or service you've requested, including being used for internal purposes such as tracking your order, analyzing your preferences, and noting trends and statistics. We may combine and supplement the information we collect about you, with information from third parties, and add it to your account information. This may include publicly available demographic information from the US Postal Service in order to verify your address so we can properly ship your order to you and to prevent fraud.

B. Non-Personal Information. JessaKae collects information that in and of itself does not permit direct association with any specific person. In the case of non-personal information JessaKae has the right to collect, transfer, use, and disclose this information for any purpose. Examples of non-personal information and its intended use:

1. Device-related information. We may collect information such as the user device identifier (IDFA), IP address of your computer and its operating system, type of mobile device, IP address of your mobile device, mobile operating system, and type of mobile Internet browsers. We use the information for the express purpose of better understanding customer behavior and improving our products and services.

2. User activity with our Services. We may collect and store details on how you interact with our services. This may help us improve our service offerings and to provide a better user experience. Portions of our Service(s) may enable you to send email and other types of messages to us and to participate in blogs, product reviews, and other discussion groups. All such emails, reviews, comments and messages, and all such postings to blogs and/or discussion groups, become our property once you submit them (please see our Terms for more details on this). C. Cookies and Other Tracking Technologies JessaKae may use “cookies” and other tracking technologies such as web beacons and pixel tags as a course of providing the Services to you. We implement these technologies in order to provide a quality user experience and to optimize the services we provide to you. The information we collect during the implementation of these technologies is treated as non-personal information. For purposes of this Privacy Policy, in the event non-personal information is combined with personal information, we treat the compiled information as personal information.

D. Third-Party Sites and Services JessaKae products, services, and applications may contain links and integration to third-party services, social media platforms, products, applications, and websites. These features may collect your IP address, which page you are visiting on our Services, and may set a cookie to enable the feature to function properly. Social media features on our Services are either hosted by a third party or directly on our Services. Your interactions with these features are governed by the respective privacy policy of the company providing such feature(s).

E. Disclosures to Third Parties From time-to-time, JessaKae may make certain personal information available to product and service partners. Specific ways JessaKae shares with third parties are described belo

  1. Third-Party Service Providers. JessaKae may elect to outsource some of its technical and customer support, marketing, advertising, tracking and reporting functions, quality assurance testing, and other services that it may deem necessary. In these specific instances, we may share information about or from you in order for them to provide their services.
  2. Business Affiliates and Transfers. JessaKae may share information from or about you with its affiliates, subsidiaries, joint ventures, or companies under common control, in which case we will require them to adhere to this Privacy Policy. In the event JessaKae, LLC is acquired in total or by a substantial amount of its assets, we will make best efforts to ensure that the purchaser will assume the rights and obligations of this Privacy Policy. However, JessaKae cannot make any guarantees or promises with respect to a purchaser adopting the current rights and obligations of this Privacy Policy.
  3. Investigations. As described in the JessaKae Terms of Service, JessaKae reserves the right to provide and/or disclose necessary information for investigatory matters to third parties. Examples include but are not limited to: 1) compliance with law enforcement or the necessary legal process; 2) behavior and/or use that violates our Terms of Service, and 3) instances whereby it is necessary to protect our rights and obligations.

F. Protection of Personal Information and Retention JessaKae takes reasonable business measures to preserve the security of your personal information. As such, we follow the generally accepted industry standards to protect all user information submitted to us. Although we implement accepted industry standards, we cannot guarantee absolute security with respect to your personal information. Given the fact that no one method of transmission over the Internet or via mobile device is 100% secure, we urge you to take the utmost care when transmitting personal information.

When you use some of the features of the JessaKae services, the personal information and content you share is visible to other users and can be read, collected, or used by them. You are responsible for the personal information you choose to share or submit in these instances. Please take care when using these features.

H. Children JessaKae is aware of the importance of protecting the privacy and safety of children who may use our services. In that regard, we do not knowingly solicit data from or market to children under the age of 13. Once notified, we will delete the information as soon as reasonably possible.

J. Privacy Policy Modifications JessaKae reserves the exclusive right to change, modify, or alter the terms of this Privacy Policy. The most current version of this policy will govern our use of your information. Continued access and use of the JessaKae Services after changes to our Privacy Policy occur indicate that you agree to be bound by the revised Privacy Policy.

K. Opt Out and Do Not Track If you decide to provide us with your contact information, you agree that we may send you communications via emails.  However, you may unsubscribe from certain communications by notifying JessaKae that you no longer wish to receive these communications. We will endeavor to promptly remove you from our mailing list once we have received that request.  We currently do not offer functionality for you to opt out through “do not track” listings. L. Third Parties JessaKae or other users may post links to third party websites on our Platform, which may include information that we have no control over.  When accessing a third party site through our Platform, you acknowledge that you are aware that these third party websites are not screened for privacy or security issues by us, and you release us from any liability for the conduct of these third party websites.  

Please be aware that this Privacy Policy, and any other policies in place, in addition to any amendments, does not create rights enforceable by third parties.  JessaKae bears no responsibility for the information collected or used by any advertiser or third party website. You must review their policies to understand how their information collection practices work.

M. International Transfer Your information may be transferred to - and maintained on - computers located outside of your state, province, country, or other governmental jurisdiction where the privacy laws may not be as protective as those in your jurisdiction.  Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer.  Any information that is submitted to JessaKae will be collected, processed, stored, disclosed and disposed of in accordance with applicable United States’ law and this policy. In addition, such information may be stored on servers located outside your resident jurisdiction. United States’ law may not provide the degree of protection for information that is available in other countries.

N. Merger and Acquisition In the event that JessaKae is involved in a bankruptcy, merger, acquisition, reorganization or sale of assets, your information may be sold or transferred as part of that transaction. Please be aware that once the information is transferred your privacy rights may change.
